For treachery to qualify killing to murder, the evidence must show: (A) The time when the accused decided to employ treachery, the overt act manifestly indicating that he clung to such determination, and a sufficient lapse of time between the decision and the execution, allowing him to reflect upon the consequence of his act. (B) Unlawful aggression, reasonable necessity of the means to prevent or repel the aggression, and lack of sufficient provocation on the part of the victim. (C) That the accused employed such means, methods or manner to ensure his safety from the defensive or retaliatory acts at the victim, and the mode of attack was consciously adopted. (D) Actual sudden physical assault or threat to inflict real imminent injury to an unsuspecting victim.
